The APE energy certificate: when you need it, what it is worth, what it costs to skip
Compulsory in the listing and in the deed, valid ten years with two conditions that void it, real penalties — and what the certificate does not say about value.
The energy performance certificate — the APE — is the document nearly everyone treats as a formality and which, two times out of three, should be arranged before anything else.
When it is compulsory
In the listing. Sale and rental advertisements must show the energy class and the performance index. This is not a layout detail: publishing without them is a sanctionable offence.
In the deed. On a sale the APE is attached to the deed and handed to the buyer, with a clause recording that the buyer received it.
In tenancy agreements, under equivalent rules.
How long it really lasts
Validity is ten years, subject to two conditions that end it sooner:
- if you carry out works that change the building's energy performance — external insulation, a new boiler, replaced windows — the certificate must be redone;
- if the statutory efficiency checks on the heating and cooling systems are not carried out, validity lapses: the certificate then expires on 31 December of the year following the one in which maintenance was due.
The second condition is the one almost everyone misses. A 2019 certificate in a drawer is not automatically valid in 2026 if the boiler logbook tells a different story.
Penalties
Article 15 of Legislative Decree 192/2005 sets amounts that are not symbolic:
- €3,000 to €18,000 for breaching the obligation to hold and hand over the certificate on a sale;
- €500 to €3,000 for advertisements published without the energy indices;
- €700 to €4,200 for an assessor who issues a certificate without following the statutory criteria and methods.
What the APE is not
It is not a valuation. It does not say what the flat is worth; it says how much energy it takes to heat and cool under a standardised calculation — standard occupants, standard temperatures, standard behaviour. A real household may use half that, or twice.
Nor is it a verdict on the property. A class G flat in a Habsburg-era building in the centre, with five-metre ceilings and historic windows, is still a flat that sells well in Trieste.
Why it matters anyway, and increasingly
The European directive on the energy performance of buildings — the "green homes" package — pushes member states towards renovation targets for the existing stock. How that becomes concrete duties for an individual Italian owner depends on the implementing decrees, which are worth reading when they exist rather than guessing at in advance.
What is already visible in real negotiations is simpler: energy class has entered buyers' questions and banks' assessments. A poor class does not block a sale, but it enters the price conversation — and it does so more often each year.
The practical advice
Get it before the listing goes up, not before the deed. It is required at publication, and holding the certificate means you know what you are talking about when the buyer asks — because they will.
